Plaintiffs claimed a declaration of title to land in dispute. The defendants, in another action also claimed a declaration of title to the said land, and both ac¬tions were consolidated.

The learned trial Judge held in favour of the plaintiffs/ap¬pellants. The defendants appealed to the Federal Court of Appeal Court of Appeal held in favour of the defendants, and reversed the findings of the trial Court.

Appellants thus appealed to the Supreme Court.
